Sales Agreement

1. PRELIMINARY INFORMATION

CONSUMER: Real persons who purchase, use or benefit from a product or service from www.arvne.com internet address for personal use within the framework of the provisions of this contract.
Subject of the Contract: This contract covers the purchases made between www.arvne.com and the CONSUMER through the website www.arvne.com and both parties are deemed to have accepted the terms of this contract.
Invoice and Delivery Information: The information entered in these forms must be correct and complete. The CONSUMER agrees to fully cover the damages arising from the situations where the information in the forms is not correct or this information is incomplete, and the CONSUMER also accepts that any responsibility that may arise from this situation belongs to the CONSUMER.

2. INFORMATION OF THE GOODS SUBJECT TO THE CONTRACT

It consists of the type, quantity, brand / model, quantity, sales price, payment method, information at the time the order is finalised.

3. RECEIVING THE ORDER:

The CONSUMER shall place all orders through the website www.arvne.com on the internet. The information entered during the order will be recorded by www.arvne.com and will be the record of the sale made.

4. PAYMENT TRANSACTIONS

When the CONSUMER completes his order over the internet, he will be offered payment options to choose from. The CONSUMER will choose the most suitable one from these options and continue his transactions in this way. If the money order reaches the bank within 24 hours after placing the order, the order will be approved. A reminder e-mail will be sent to consumers whose money order does not reach the bank within two business days. Orders that do not reach the bank again are cancelled. Unless the order price is transferred to our company account, the consumer has no right to request delivery.

Consumers who send payment by Bank Transfer or EFT must fill out the ‘Remittance Notification Form’ and forward it to our company. www.arvne.com is authorised to change, increase, decrease or remove payment options in the future. www.arvne.com is obliged to protect the information provided by the consumer for payment purposes.

5. PROCUREMENT OF PRODUCTS

The display made on the website is an invitation to an invitation in the sense of the Code of Obligations. If the product stock, price error or the product ordered by the consumer cannot be supplied for any reason; This situation will be notified to the CONSUMER and if the consumer requests, the product price will be returned to the CONSUMER within 14 days from the date of request without any deduction.

6. SHIPMENT OF PRODUCTS AND PRICING OF SHIPMENTS:

Product shipment is made from two different centres. For orders coming from the European region Hohenbrunn - GERMANY for orders from the European order point located in Hohenbrunn, orders from Turkey are shipped from our centre in Aydin, Turkey. Products are sent by contracted cargo company.


The shipping time of the products is 3 business days at the latest after the order confirmation e-mail is sent.
Orders are sent to the consumer's address. www.arvne.com can deliver products to all points of Turkey with contracted cargo companies. If there is no cargo agency in the place where the Consumer is located, this place is called Mobile Zone and product delivery is made on certain days of the week.


In case the CONSUMER refuses to receive the product; www.arvne.com will have the right to demand the product price and other damages or immediately terminate the contract and claim damages.


www.arvne.com cannot be held responsible in any way for delays in deliveries by cargo companies, damages or loss that may occur during transportation.
The transportation and shipping costs of purchases over 1500TL within Turkey belongs to www.arvne.com. The transportation fee of the goods under 1500TL belongs to the CONSUMER. 

*For purchases made in Europe and abroad, the shipping fee belongs entirely to the consumer. However, in any case, the damage and benefit will pass to the CONSUMER with the delivery of the goods to the transportation or cargo.

7. WARRANTY AND RETURN PROCEDURES

According to Article 4 of the Law on the Protection of Consumers, ‘Goods that are contrary to the qualifications in the introduction and user manual or advertisements and announcements or that contain material, legal or economic deficiencies that reduce the benefits expected by the consumer in terms of intended use are considered defective goods. If the CONSUMER notifies the defective goods within 180 days from the date of delivery of the goods, he has one of the rights to price reduction, free replacement or free repair.’

Purchases made through the website cannot be returned and exchanged from the store.

8. RIGHT OF WITHDRAWAL

The CONSUMER can cancel the order placed by sending an e-mail to our whatsapp support line or siparis@arvne.com until 17:00 on the same day.


According to Article 8 of the Regulation on Distance Contracts, the CONSUMER has the right to withdraw from the contract by rejecting the goods without any responsibility and without any justification within seven days from the date of receipt of the product. Accordingly, the Consumer has the right to return the product without any reason within 14 days after receiving the product.


In order for the consumer to benefit from the right of withdrawal;

- The sale made 4077 sy. Based on a sales contract within the scope of the Law on Consumer Protection,
- The return must be made within a period of fourteen (14) days from the date of delivery of the purchased product without opening, destroying, spoiling and using the product.
- Return requests are not accepted in cases where the labels affixed by the importer or manufacturer company on the box of the product are torn, vacuum or gelatine packaging is opened.
- In order for the return transactions to take place, the CONSUMER must first apply to www.arvne.com in writing. Return requests to be made without application will not be accepted.
 - In order to benefit from the right, there must be no damage to the purchased product and the product must be in a resalable condition.
- The consumer is obliged to return the product in the condition in which it was delivered to him and, in case of use, to compensate for the loss in the commercial value of the goods due to use.
- The right of withdrawal cannot be used in goods produced in accordance with the special requests and demands of the consumer or personalised by making changes or additions.
Your orders that reach our system are delivered to the cargo on the same day on weekdays (Monday to Saturday) following the payment confirmation from your bank. Orders received on Sunday are delivered at the end of working hours on Monday. Cargo to your address to reach the average maximum 3 working days across Turkey. Order cancellations can be requested with a written explanation from our ‘contact’ section. Please take care to send this request on the same day after clicking the ‘place the order’ button. If your order has been delivered to the cargo before your cancellation request, the following return procedures will be applied.

9. CONFIDENTIALITY

Arven Tekstil undertakes to keep the information registered by its users for the purpose of shopping on the website www.arvne.com confidential under all circumstances.
Arven Tekstil undertakes and guarantees not to disclose the information entered on the website for any reason without the consent of the CONSUMER and not to share such information with third parties.
Since www.arvne.com carries out credit card transactions through IYZICO, no information about the CONSUMER's credit card will be stored on the internet, so the payment information to be used for shopping on the site will remain the consumer's.

10. OTHER PROVISIONS

10.1 No sales are made to persons under the age of 18 via www.arvne.com. The CONSUMER has accepted this situation and has undertaken not to provide misleading information to www.arvne.com for any reason.
10.2 www.arvne.com is obliged to continuously check all product information and prices on the website. However, www.arvne.com is not responsible for any situation arising from typographical or calculation errors.
10.3 The prices appearing on the website are inclusive of VAT. Changes in tax rates are reflected to the CONSUMER.
10.4 www.arvne.com has the right to stop the service it provides for a certain period of time or completely at any time. In the event of such a situation, www.arvne.com has no liability to private members and third parties. 

10.5 www.arvne.com has the ownership of software, documents, information, graphics and similar works that it purchases from outside or obtains through its own work. Copyrights that may arise from this ownership belong to www.arvne.com.
10.6 www.arvne.com has the right to turn some sections within the site into sections that can be entered encrypted and also has the right to turn sections that do not require membership into sections that require membership.
10.7 Situations (such as Natural Disaster, War, Terrorism, import law, Strike, etc.) that do not exist on the date of approval of the contract, but which occur later and prevent one or two of the parties to the contract from fulfilling their responsibilities will be force majeure. In this case, the party affected by force majeure shall notify the other party in writing. During the continuation of force majeure, the parties are not obliged to fulfil the provisions of the contract. If the force majeure does not disappear within 10 days, each party reserves the right to terminate the contract unilaterally. 

10.8 All CONSUMERS who purchase products from the www.arvne.com website are deemed to have read and accepted all of the articles in the contract. Consumer; If he/she does not tick the box that he/she approves this contract, he/she will not be able to approve the order, and the will of acceptance of this contract arises with the approval of the order.
10.9 The CONSUMER accepts that all responsibility for his/her personal thoughts and ideas used in the common areas of use within the site belongs to him/her. www.arvne.com is in no way responsible for all problems that may arise from its writings.
10.10 In disputes arising from this contract, www.arvne.com records will be accepted as binding and conclusive evidence. If the CONSUMER signs this contract or approves it on the website, it is deemed to have accepted all the provisions contained in the contract. Correspondence between the parties in electronic environment shall be accepted as evidence.
10.11 This contract starts when the CONSUMER receives any service or completes the order through the website www.arvne.com. The CONSUMER is deemed to have undertaken indefinitely to comply with each article of this contract. The fact that the payment process has not yet been completed by the CONSUMER does not eliminate the provisions of the contract.
10.12 The provisions of Turkish substantive and procedural law shall apply to this contract and Aydın/Turkey Courts and executive directorates shall be competent in cases of disputes arising from the application of this contract.
